Article 1 – Definition of Terms
In these Terms and Conditions, the following terms are understood as follows:
1.1 Supplementary Contract: A contract under which the consumer acquires products, digital content, or services in connection with a distance contract, supplied by the trader or a third party based on an agreement between the trader and that third party.
1.2 Cooling-Off Period: The period within which the consumer may exercise their right of withdrawal.
1.3 Consumer: A natural person not acting for purposes related to trade, business, craft, or profession.
1.4 Day: A calendar day.
1.5 Digital Content: Data produced and supplied in digital form.
1.6 Term Contract: A contract for the regular supply of goods, services, and/or digital content over a defined period.
1.7 Durable Data Carrier: Any device (including email) that enables the consumer or trader to store information in a way that allows future consultation and unaltered reproduction.
1.8 Right of Withdrawal: The consumer’s right to withdraw from the distance contract within the cooling-off period.
1.9 Trader: REZAYÉ, the entity offering products or services remotely.
1.10 Distance Contract: A contract concluded between REZAYÉ and the consumer through an organized system for remote sales without physical presence during conclusion.
1.11 Technology for Remote Communication: Tools enabling contract conclusion without physical presence.

Article 3 – Applicability
3.1 These Terms apply to all offers, distance contracts, and online purchases made from REZAYÉ.
3.2 Prior to contract conclusion, these Terms will be made available to the consumer.
3.3 If the contract is concluded electronically, these Terms will be provided in a durable digital format.
3.4 If additional product-specific conditions apply, the consumer may rely on the provision most favorable to them in case of conflict.
3.5 The REZAYÉ Frequently Asked Questions (“FAQs”) form an integral part of these Terms and Conditions. By using the website or placing an order, the consumer acknowledges that the information and policies stated in the FAQs apply in conjunction with these Terms. In the event of any inconsistency between the FAQs and these Terms, the provision most favorable to the consumer shall prevail in accordance with EU consumer protection standards.
Article 4 – The Offer
4.1 If an offer has limited validity or special conditions, this will be stated clearly.
4.2 Product descriptions are accurate and sufficiently detailed, though minor variations may occur due to lighting or handcrafted characteristics.
4.3 Each offer clearly states the rights and obligations tied to acceptance, including pricing and delivery information.
Article 5 – The Contract
5.1 A contract is concluded once the consumer accepts the offer and completes the required steps.
5.2 When accepted electronically, REZAYÉ confirms receipt without delay.
5.3 REZAYÉ implements secure technologies to protect personal and payment data.
5.4 Where permitted by law, REZAYÉ may perform checks on payment ability or fraud risk.
5.5 Upon delivery, REZAYÉ provides legally required documentation including contact details, withdrawal instructions, warranty information, pricing, taxes, and contract termination terms where applicable.
Article 6 – Right of Withdrawal
6.1 General Withdrawal Rights
Consumers may withdraw from an eligible purchase under the terms below.
Note: REZAYÉ operates a 30-day return policy, which exceeds EU minimum requirements.
6.2 Start of Withdrawal Period
The 30-day return period begins on the day after the consumer—or an authorized third party—receives the product.
6.3 Services or Digital Content
For services or digital content not supplied on a tangible medium, the withdrawal period begins the day after contract conclusion.
Article 7 – Consumer Obligations During the Withdrawal Period
7.1 During the return period, consumers must handle items carefully and inspect them only as permitted in a boutique setting.
7.2 Any diminished value resulting from improper handling may be deducted from the refund.
Article 8 – Exercise of the Right of Withdrawal and Return Conditions
8.1 Return Notification
Consumers must notify REZAYÉ via customer service, stating the order number and items being returned.
8.2 30-Day Return Policy
REZAYÉ offers a 30-day return policy for a full refund or exchange. To qualify, the item must:
– Be unworn and in perfect, original condition
– Include all luxury packaging and certification documents
– Have the original tamper-evident security tag or seal intact
If the security seal is removed or broken, the return cannot be accepted.
8.3 Exclusions (Final Sale Items)
The following items cannot be returned or exchanged:
– Engraved pieces
– Custom-designed jewelry
– Altered items (including resizing or modifications upon request)
– Any product manufactured specifically to the consumer’s specifications
8.4 Return Shipment
The consumer must return the product within 30 days of notifying REZAYÉ. Items must be returned using reasonable packaging and provided instructions.
Risk of shipment remains with the consumer until REZAYÉ receives the item.
8.5 Refunds
Refunds are issued within 14 days of receiving the returned item (or proof of shipment), using the original payment method.
Article 9 – Obligations of the Trader in Case of Withdrawal
9.1 REZAYÉ will confirm receipt of withdrawal requests electronically.
9.2 All eligible payments, including standard delivery costs, will be refunded.
9.3 Additional delivery upgrades chosen by the customer (such as express shipping) are not refunded.
Article 10 – Exclusions From Withdrawal Rights
For clarity under EU law, REZAYÉ may exclude:
– Customized and engraved jewelry
– Items irreversibly altered
– Products no longer in original condition
– Items missing certification documents or broken security seals
– Digital content accessed with prior consent
Article 11 – Pricing
Prices are listed inclusive of VAT where applicable.
Prices may vary due to market conditions but will not increase after the contract is concluded unless legally required.
Article 12 – Product Conformity and Warranty
12.1 REZAYÉ ensures that products meet the specifications in the offer and comply with applicable regulations.
12.2 Items are guaranteed suitable for normal use.
12.3 Additional warranties do not diminish statutory consumer rights.
Article 13 – Delivery and Performance
13.1 REZAYÉ handles orders with utmost care.
13.2 Delivery takes place at the address provided by the consumer.
13.3 Orders are delivered within the estimated timeframe. Delays will be communicated promptly.
13.4 Until delivery, REZAYÉ bears the risk of loss or damage.
Article 14 – Ongoing Contracts, Termination, and Renewal
Not typically applicable for jewelry purchases; however, if services or subscriptions exist, EU rules regarding termination and renewal apply.
Article 15 – Payment
15.1 Payment must be completed within the timeline specified during checkout.
15.2 Advance payments exceeding 50% cannot be required under EU law unless mutually agreed.
15.3 Payment errors must be reported immediately.
15.4 Late payments may incur statutory interest and EU-regulated collection fees.
Article 16 – Complaints Procedure
16.1 REZAYÉ maintains a clear complaint-handling procedure.
16.2 Complaints must be submitted promptly and in writing.
16.3 REZAYÉ responds within 14 days with a resolution or timeline.
Article 17 – Retention of Title
Ownership transfers only upon full payment. Risk transfers upon delivery.
Article 18 – Applicable Law
These Terms are governed by Dutch law, incorporating strict EU consumer standards, and may be enforced internationally unless mandatory local laws apply.
REZAYÉ reserves the right to amend these Terms, with consumer-favorable interpretations prevailing in case of conflict.
